That means it is a way to sort out a conflict without going to court or a tribunal, or before you do.<\/p>\n<p>The Dispute Settlement Centre of Victoria <a href=\"https:\/\/www.vic.gov.au\/mediation-dispute-settlement-centre-victoria\">describes mediation<\/a> as a voluntary and confidential process where people try to resolve their issues with the help of a trained, impartial mediator.<\/p>\n<p>Key features of mediation include:<\/p>\n<ul>\n<li><strong>Impartial.<\/strong> The mediator does not take sides, give a verdict or decide who is right.<\/li>\n<li><strong>Self-determination.<\/strong> You and the other person make the decisions. Nothing is agreed unless you both agree.<\/li>\n<li><strong>Voluntary.<\/strong> In most settings, no one can be forced to take part or to reach an agreement.<\/li>\n<li><strong>Confidential.<\/strong> What is said is usually kept private, within limits explained at the start.<\/li>\n<li><strong>Future focused.<\/strong> The aim is to find workable arrangements for the future, rather than to go over every detail of the past.<\/li>\n<\/ul>\n<h2>What kinds of disputes can mediation help with?<\/h2>\n<p>Mediation is used in many settings, including:<\/p>\n<ul>\n<li><strong>Family and separation:<\/strong> arrangements for children, communication between parents, and property matters<\/li>\n<li><strong>Workplace:<\/strong> conflict between colleagues, or between a staff member and a manager<\/li>\n<li><strong>Return to work after injury:<\/strong> discussions about duties, hours and support when someone is coming back to work<\/li>\n<li><strong>Community and neighbours:<\/strong> issues such as fences, trees, noise and shared spaces<\/li>\n<li><strong>Business and consumer disputes:<\/strong> such as contracts, services or payments<\/li>\n<\/ul>\n<p>For parenting disputes after separation, special rules apply. Intake and assessment<\/h3>\n<p>The mediator usually meets each person separately first. They explain the process, hear about the dispute and check whether mediation is safe and suitable. This includes asking about family violence, safety concerns and anything that could make it hard for someone to take part.<\/p>\n<h3>2. Preparation<\/h3>\n<p>You may be asked to think about the issues that matter most to you, what you need, and possible options. In some cases you might gather documents, such as rosters, emails or financial information.<\/p>\n<h3>3. The joint session<\/h3>\n<p>At the main session, the mediator sets ground rules and gives each person time to explain their view without interruption. The mediator then helps you both list the issues, understand each other&#8217;s concerns and explore options.<\/p>\n<h3>4. Private sessions<\/h3>\n<p>The mediator may meet with each person on their own during the day. These private sessions give you space to think, raise concerns you do not want to share yet, and test options.<\/p>\n<h3>5. Agreement<\/h3>\n<p>If you reach an agreement, the mediator can help you write it down clearly. If you do not agree on everything, you may still have narrowed the issues or agreed on some points.<\/p>\n<h3>6. Follow up<\/h3>\n<p>Some mediators offer a follow up conversation to see how the agreement is working and whether anything needs adjusting.<\/p>\n<p>Mediation can happen in person, online, or in a shuttle format, where the people stay in separate rooms and the mediator moves between them.<\/p>\n<h2>When mediation may not be suitable<\/h2>\n<p>Mediation relies on each person being able to speak freely and make decisions safely. It may not be suitable when:<\/p>\n<ul>\n<li>there is family violence, abuse or a risk to someone&#8217;s safety<\/li>\n<li>one person is afraid of, or controlled by, the other<\/li>\n<li>there is a large imbalance of power that cannot be managed<\/li>\n<li>someone is unable to take part effectively, for example because of a health condition, even with support<\/li>\n<li>the matter involves serious misconduct or a crime that needs a formal investigation<\/li>\n<li>you need a court or tribunal to make a binding ruling, or the matter is urgent<\/li>\n<\/ul>\n<p>A good mediator will screen for these issues and may suggest changes, such as shuttle mediation or support people, or recommend a different path.<\/p>\n<p>If you are in danger, call 000. You do not have to agree with it to understand it.<\/li>\n<li><strong>Consider options.<\/strong> Come with a few possible solutions, not just one fixed outcome.<\/li>\n<li><strong>Gather key information.<\/strong> Bring any documents that help explain the issues.<\/li>\n<li><strong>Look after yourself.<\/strong> Plan breaks, eat well beforehand and arrange support for afterwards. Mediation can be tiring.<\/li>\n<li><strong>Get advice if you need it.<\/strong> For legal or financial matters, talk to a lawyer before the session so you understand your rights.<\/li>\n<\/ul>\n<h2>Agreements, confidentiality and accreditation<\/h2>\n<h3>Is a mediated agreement binding?<\/h3>\n<p>It depends. Many mediated agreements are informal and rely on goodwill. Some can be made legally binding, for example as a signed contract or deed, or in family law as consent orders filed with the court. If the agreement matters legally or financially, get independent legal advice before you sign.<\/p>\n<h3>How confidential is mediation?<\/h3>\n<p>Mediation is usually confidential, and the mediator will explain any limits at the start. Common exceptions include risks to someone&#8217;s safety, concerns about a child&#8217;s safety, and where the law requires information to be shared.<\/p>\n<h3>How do I know a mediator is accredited?<\/h3>\n<p>In Australia, mediators can be accredited under the Australian Mediator and Dispute Resolution Accreditation Standards (AMDRAS). AMDRAS replaced the National Mediator Accreditation System in July 2024. You can check a mediator on the <a href=\"https:\/\/amdras.au\/mediators\/\">national register of accredited mediators<\/a>.<\/p>\n<p>Family dispute resolution for parenting matters is different. There are some exceptions. Support people usually do not take part in the discussion. In some family and workplace mediations, lawyers attend or are available by phone.
